Before deciding how to pursue a commercial dispute, you may need to understand what assets are associated with a person or business. ASE considers tracing enquiries focused on that question.

Agree the purpose first

The scope may cover property interests, company holdings and ownership connections, using information that can properly be obtained for the instruction. Tell us whether your enquiry relates to a potential claim, an existing dispute or a matter already involving legal advisers.

Assets connected to a debtor

Where money is owed, asset searches can help establish what property interests, company holdings or other assets are connected to a debtor. That picture can inform your discussions with your legal advisers before recovery is considered.

Can you obtain private bank information?

ASE does not offer unauthorised access to private banking or other confidential records. Information requiring a formal legal process must be discussed with the appropriate legal adviser.

Does tracing mean money will be recovered?

No. This service concerns investigating asset information. Recovery and enforcement are separate matters, and identifying an asset does not guarantee that it is available for recovery.

What about assets overseas?

International requirements are assessed individually. We discuss the relevant locations and practical limitations before agreeing the work.

What can an asset search look for?

Depending on the instruction, asset tracing may look for property and land interests, company holdings, directorships and beneficial ownership. It uses information that can lawfully be obtained, and we explain at the outset what is and is not available for your matter.

Is asset tracing instructed before or after legal action?

It can be either. An asset search before a claim can help you and your advisers judge whether the claim is worth pursuing. After a judgment, tracing can inform decisions about enforcement, which remains a separate matter for your legal advisers.
